Everything you need to know about record expungement in Florida

If you are charged with a crime in Florida, there are ramifications that may follow you throughout your life. On certain occasions, there is the possibility of cleaning your record, making it easier to find a job and receive background checks. This post will look at what record expungement is and if you are eligible for it.

What is criminal record expungement?

It is easy for anyone to find a criminal record in the state of Florida. According to the Florida Department of Law Enforcement, “an expunged record is removed from record systems or files and destroyed.” Basically, this means that if you get your criminal record expunged, the arrest or charge will no longer be on your record.

Who can request expungement?

In Florida, not all charges or convictions can be expunged. If a judge found you guilty of a crime, you will not be eligible for expungement. You may be eligible for expungement if:

  • A judge did not find you guilty of a crime. This means that the charges were dropped or dismissed, or none were filed. If a judge has found you guilty, you will not be able to request expungement.
  • You have not gotten another record expunged. If you have already undergone the expungement process for a previous crime, it is likely that you are not eligible for expungement in the state of Florida
  • You have not entered a guilty plea. If you have pled guilty to a crime you will not be eligible to expunge your record.

If you find that you have met the requirements for record expungement, you will be able to file a Certificate of Eligibility and petition Florida courts to expunge your record.
